Mandatory Injury Reporting Policy

Suppliers on Dropshipzone must ensure that they are aware of their obligations under the Australian Consumer Law (“ACL”) to report incidents to the ACCC when they become aware of a death, serious injury or illness of any person which was or may have been caused by the use or foreseeable misuse of products they sell on Dropshipzone.

It is also important that Dropshipzone is made aware of these incidents in the event that we need to assist Retailers and their end customers or relevant authorities with investigations. As a Supplier on Dropshipzone, you are required to -

 

1. Comply with your obligations to report deaths, serious injuries and illnesses in accordance with the ACL; and
2. Notify Dropshipzone as soon as you become aware of a reportable death or serious injury or illness relating to a product you have sold on Dropshipzone

 
 

Dropshipzone reserves the right to remove any product from its platform that is the subject of a report or a report of a suspected death or serious injury or illness arising from the consumption of that product. In addition, Dropshipzone reserves the right to share information with regulators about any Suppliers who breach this policy.

Dropshipzone may also take further compliance action against a Supplier found to be in breach of this policy including suspending or terminating the Supplier from Dropshipzone.

 

Definition of a serious injury or illness:

A serious injury or illness is one that is -

1. Acute, that is it onsets quickly or suddenly or is directly and immediately caused by something;
2. Requires medical or surgical treatment; and
3. The treatment is by a doctor or nurse in a hospital, clinic or similar facility

 

Suppliers should refer to the Product Safety Australia website or seek legal advice if they are unsure whether an injury is reportable.
